Legal Question in Civil Rights Law in California

Hello,
My sisters 10 year old nephew Landon (African American) was playing with his friend who is Caucasian, the two boys were throwing rocks in the street. A 40 year old white man came and began the chase the boys, he pushed the white boy to the side and grabbed Landon stating "I got you now little nigger". He threw Landon in his car and drove off. Landon was able to text his mom that he hand been kidnapped and to please call the police. The man then drove Landon to the police station. The Caucasian boy went inside and said nothing to his parents about what happened. Landon and his family are obviously traumatized by this event and the police say they cant charge the man with anything because the man drove Landon to the police station. Is there anything the parents can do legally?

Sue the man in small claims court for $7500 for false arrest and false imprisonment.
