Legal Question in Civil Rights Law in California
My son was a Calif. Dept. of Corrections employee who got caught doing something illegal. He was arrested & gave the Internal Affairs Dept consent to search his room in our home. He had only just moved back home in the last 2 days b4 his arrest. When they came to our home my husb. was asleep. They asked me if there were any firearms in the house & I said yes but not any were loaded.
They had me wake up my husb. They completely surrounded me with hands on guns and 1 officer behind us all with his gun drawn pointed right at my head. There were 5-6 officers and I am 5'2" and 59 yrs old & disabled. I woke my husb. & we cooperated with them entirely. We had no knowledge of anything as he was not living here at the time of all this stuff happening. They had no search warrant only a consent to search his room. Well since all this my husb has died & I'm having horrible flashbacks & am just a wreck. They told us they were going to do a visual check of house but not search it per se. Well they did search my room as my closet door (which is very hard to move) was slid al the way to the other side. Seems like maybe they violated my rights on this & I'm not sure which type of attorney to consult. Can anyone give my some advice??
