Legal Question in Civil Rights Law in California

My sons father caught a new case in the county jail w.v.d.c for fighting with an inmate . when he 1st found out about this new case on him he told me he felt he was set up or something, he said that the cell he was suppose to go to was given to another inmate that was scared because his celly in his other cell was acting up and my sons father was put in the cell with the guy who was acting up. now from my understanding the guy who was acting up had been begging the guards to get P.C and they wouldn't give it to him. my sons father said he was hit from behind and did nothing but defend him self he said he didn't now this guy and didn't know what he was capable of so he fought him thinking about his 2 babies. now this inmate who was acting up was taken in for H.S 11378 & H.S 11379.2. My sons father made a complaint in the jail that deputy ? & deputy ? acted under the color of authority of state law on 8/15/10 with recklessness &deliberate indifference for his safety & life by moving him into a cell, the findings was, dept. personnel can move you @any time for facility convenience.initial inmate grievance: my sons father wrote: I am writing this grievance to bring light that my federal rights have been violated by deputy _ & deputy_ both were acting under the color of law, which I wrote above so continuing after that says I was given my discovery by the public defender's office on 1/4/11 via the the legal mail system here. to start on 8/15/10 I was rehoused to 3-F-01 from male classification, but instead deputy _ & _ were having problems with, according to official police reports deputy _ &_ moved an inmate the "victims" last Celie "for having problems with the victim" in the police report deputy _ has falsified an official document deputy _ states that I was housed in 3-F-01with a different inmate that is a complete false statement, deputy _&_ shot me over straight to 3-E-15 to enter the little gladiator match deputy _ &_ claim they moved me to 3-E-15 for "facility tranquility" they moved me there to see a fight they knew I would be attacked & I would be forced to fight to protect my self & because I would not speak to them or file charges, I now have a new case against me FWV1002101 both deputy_ &_ knew of the substantial risk of serious harm,& both failed to respond reasonably under the color of state law, they put my life & safety at risk.now on 11/1/10 deputy liddicote has requested that deputy _ do the additional investigation on this case I don't feel this is fair due to the fact that I am saying deputy_ is the reckless deputy, a mad man with a badge dep _ will not investigate for the truth cause, IF the truth comes out deputy_ will be the one in the defendant seat.

so my sons father had a prelim Feb 17 with the deputy as a witness that my sons father says is the dirty one when this deputy got on the stand he seem vary nervous and his mouth would not stop quivering or shaking towards the end my sons fathers defender got 2 or 3 different stories and paused & told the judge the deputy was lying and the judge said the victim wanted a fight and my sons father gave it to him. the victim told my sons father I'm suppose to be by myself your not suppose to be in here with me and the guard even said that. next court date is march 2 I am so scared I don't know whats gonna happen. my almost to be 2 year old is ill and has seizures and his father in jail its really stressful and I just hope for the best. can someone on here tell me what you think. my sons father wanted me to get a civil rights lawyer my mom tried to call this one lawyer but he wont even call back because of my sons fathers record. he even wanted me to get a hold of the ACLU but I don't know if they would be able to help. my sons father said the victim hit him isn't that mutual combat? but the victim claims he was attacked and just balled up but my sons father had a bump on his head from what the nurse in there said.my sons father always complains about this he don't see how there taking the victims word when no one even saw who started it.my sons father story never changes when he talks to me about what happen.
