Legal Question in Civil Rights Law in California

my sons father picked up a new case in jail for fighting with another inmate and now they are trying to give him more time, my sons father said he was attacked and did nothing but protect himself the inmate who he fought with made a report and said my sons father attacked him. from what i understand the inmate who was acting up they pulled his celly and put him in a different cell and put my sons father with the guy who was acting up. my sons father feels he might have been set up and does not want to take more time. He says he wants me to get together with a civil rights lawyer and see about opening up a law suit. he feels he is being done so wrong. and wants to give me the report papers because he feels they might take them from him. PLEASE HELP!!! what should I do? if it were not for this new case he would be home in June. my son is sick and has seizures hes not even 2 yet and is on meds . sorry I wasn't able to give you enough info but please tell me what are some things we can do? I need my sons father out.

You will likely have a difficult time to prove what actually happened. If there is an independent witness then you may have a good case.
