if a process server steals a denfendants mail...what laws would he be violating

As you no doubt know it is a federal crime to steal mailpieces from the U.S. Mail; the U.S. Postal Inspection Service investigates allegations of crimes involving the mails. The process server would also be liable in a civil lawsuit for trespass, conversion, invasion of privacy, and possibly unfair debt collection practices.

But it sure would be an interesting, if highly illegal, way for the process server to prove that the person named in the summons receives mail at the address where he or she was served.
