stolen phone
I was given a phone by a girlfriend. We have since broken up and I have moved across the country. she wants me to give the phone back and is threatening t file a police report saying that I stole the phone. I want to know what my rights are since I have been gone for almost 2 months and the phone was a gift.

Send her a letter, telling her that the phone was a gift, and that you do not feel the need to return it. She may not have to keep up the payments on the phone's usage but if she gave this to you on or about a special occasion or you have other proof then you should state that in the letter as well. While the letter may be self serving, at least you will be on record as to your position which could help convince a district attorney not to proceed with challenges. OTOH you could avoid it all by just returning the phone.
