Legal Question in Civil Rights Law in California
I have been subpoenaed to testify in a deposition and have no recollection of the events. I will also be summoned to testify in the trial. After witnessing the incident, whenever I think about the event I nearly faint. I wound up in the urgent care due to weight loss, lack of sleep and debilitating anxiety. I will break if I have to testify and potentially lose my job. Am I required by law to testify if I can't recall the event?

Have your doctor provide a note concerning the medical inability to testify. Send that note to the attorney that issued the subpoena. If that does not work then you may have to hire an attorney to file a Motion to Quash the subpoena.
