Legal Question in Civil Rights Law in California

I am suing the County of Los Angeles. I sent in a claim late. I sent a letter quoting Government Code section 945.3 under which my late claim is acceptable.

I received a letter from the County. The contents of that letter, in part, are as follows:

�An investigation of this matter has failed to indicate that you have met the requirements under which an application to present a late claim would be approved. Therefore, no further action will be taken on this portion of your claim.

STAE LAW REQUIRES THAT YOU BE GIVEN THE FOLLOWING WARNING

If you wish to file a court action in this matter, you must first petition the appropriate court for an order relieving you from the provisions of Government Code section 9454.5 (claims presentation requirement).�

My question is: How do I petition the court?

Suing the county is difficult even for attorneys. You won't be able to do it by yourself. You would have to file a timely petition in the superior court for leave to present a late claim (if your claim was indeed presented late).
