summons
is it legal to serve someone a legal summons on a sunday? And is it legally binding if they serve someone other then the person being sued?

Yes, and yes. If the person served is an adult occupant of the residence, then the server has to mail a copy of the summons and the complaint to the defendant at the same address, as well. The same is true at a business address - the person served has to be the person apparently in charge of the office, and a copy must be mailed to the defendant at the business address, as well.
