Legal Question in Civil Rights Law in California

Temporary restraining order againt myself

I have a temporary restraining order against me. The person stated false statements on the form. If I can show that she lied, would the odds be in my favor as far as not getting a permanent restrainer against me?

It depends whether you have witnesses, evidence, etc. Usually the judge will weigh the credibility of the various parties. If you can show why the other party's statements are not credible (without calling that person names, but offering the evidence without emotion and vitriol), you might succeed. Often, you might be able to negotiate something before the hearing -- perhaps a mutual restraining order or an informal agreement to avoid a restraining order. Good luck!
