If the tenant consistently pays rent late, the next time when rent is due -- i.e. the first of the month -- you might serve on the following day a 3-day notice to pay or quit. Then, if the tenant does not fully pay the rent within those 3 days, you shouldn't accept any more money from her and file an unlawful detainer (eviction) lawsuit in court.
