Legal Question in Civil Rights Law in California
Ticketed for Bikini-Police harassment
27 yr old Female ticketed for wearing tank-top and full bottom bikini in public. The ticket indicates ''exposing private parts''. Her rights were administered and then forced to a side street to be photographed by female officer while five male officers watched and commented. Female was told to pose but pleaded not to be photographed in the street and in front of male officers. An off-duty officer aware of the situation retrieved the female's number from the ticket and made contact with the female at home and work to help ''fix'' the ticket.
Is this police action a violation of her rights?

Thanks for your inquiry. Section 1983 of Title 42 of the United States Code allows individuals to sue individuals acting under the color of law for constitutional rights violations. Based on the limited facts that you have provided here, there may have been an unlawful search or seizure in violation of the 4th amendment as well as Section 1983 claims based on false arrest and imprisonment. Please feel free to contact our firm if you wish to discuss your situation further.
