when in tort law does the actions of a defendant become negligent and cause emotional distress

From what side of the spectrum are you asking? From very innocent non-negligent acts going up to being negligent, or from acts constituting intentional torts going down to being negligent? Well, in the typical complaint, "negligent infliction of emotional distress" is pleaded as when the defendant had a duty owed to plaintiff, breached that duty by acting negligent, and which caused the emotional distress on plaintiff's part.
