Legal Question in Civil Rights Law in California
My wife recently rented two video games from blockbuster that were due by 1-10-2011 and were returned the 8th. On the 12th they took out $119.00 out of my bank account. I called the video store manager and then blockbusters customer service and they reversed the fees and said it would take 3-5 business days to get put back in our account. The problem is my daughter has a terminal illness and i need the money now for medications and i explained this to them. I feel since they illegally took money out of my account i shouldn't have to wait because now i can not afford to buy my daughters medication. Is there anything i can do i explained i would contact an attorney and they really didnt seem sorry that i would not be able to buy my daughters medication. She takes almost 30 meds and it really takes a toll on our family and now we have to worry about how to come up with the money they shouldn't of took out. I am tired of companies like this taking advantage of people and not giving a darn . what if anything can i do? Thank you for your time Charles Dobbins

You may have a good case for violation of the Rosenthal Fair Debt Collection Practices Act that would entitle you to at least $1,000 in damages plus your attorney fees. I wish I was in your area or I would consider handling your case. I am sorry your daughter has a terminal illness and I wish you the best of luck in finding an attorney in your locality. Watch out for legal time limits.
