wrong information in medical record

My treating physician for an auto accident injury reported to the insurance false information about me, she said in one of her reports I was a former drug addict and that she new my HIV status, both statements are false, in another report she stated that I was diagnosed with Lupus, this is also false, what are my legal rights to force her to correct the reports and do I have the right to initiate a legal action against her for difamation?

It's probably not defamatory unless she intended to provide false information about you.

Nevertheless, send her and the carrier a certified, return receipt letter demanding that the record be corrected and provide specifics, of course. You might also write to her superior if you don't get satisfaction within the deadline you set in the letter.
