Legal Question in Technology Law in California
What if I use my businesses computer system to launch a website without their permission, and then sell advertising space on my website?
1 Answer from Attorneys
What do you mean by "my businesses?" Are you referring to a business you own or control? That's what I would think "my business" would mean. However, it sounds more like you are referring to your employer's business.
Generally speaking, using an employer's computer for any personal or non-job-related purpose is contrary to your terms of employment and/or a form of trespass to chattels. Further, you don't know to what extent your activity and transmissions are being recorded or monitored.
So, the answer to "what if" could range from "nothing at all" to a serious lawsuit, depending upon (1) the employer catching you; (2) the employer's attitude toward your transgression; and (3) the degree of financial harm done to the employer.
