Copyright Music

My question is very simple. Is it Illegal to create a cartoon movie (Flash) with part of a Copyrighted song, and have it available for download in a website for non-profit use?

Use, copying or other reproduction of copyrighted works is infringement. Unless you are taking a very small riff (sampling) you will need permission to borrow the song.

THe fact that your purpose is "non-profit" is irrelevant to the issue as to whether it is illegal (it is). Profits can be disgorged from an infringer OR an infringer may be subject to statutory damages of $1000 to $100,000 (as well as injunctions) even if they made no $ for the infringement.
