Legal Question in Technology Law in California

Dear Lawguru Team,

I have a Playstation 2 (created by Sony) and Karoake Revolution presents American Idol for Playstation 2. The American Idol game does not work due to disc damages. I bought the game from Gamestop who does not sell a warranty for the American Idol game. My computer, i believe, is able to read the disc. Is it illegal to copy it to another disc just so the game can play on my Playstation 2?

Yes, because doing so would require you to break a copyright protection system which is against the anti-circumvention act. You should contact the maker of the game to see if they can give you a refund or replacement. Alternatively, since you recently purchased it from gamestop, return it and get a refund from them.

You say that Gamestop does not sell a warranty. They don't need to sell one and you don't need to buy one, because you get one for free. New merchandise carries an implied warranty that it is free from defects and fit for use at the time sold. Take it back and demand an exchange.
