Domain Name Transfer

There are 3 partners planning to start a business. They have a signed NDA. 2 of the partners discuss and come up with a Domain Name that they think would be great for the business. One of the partners communicates the name to the 3rd partner that this is what they are thinking. The 3rd partner goes and purchases the domain name. For a variety of reasons the 3rd partner decides not be part of the venture. But out of spite he is not returning the domain name. Can something be done to get the domain name back from him.

Can something be done to get the domain name back? Yes, but why don't you just pick a different domain name and save yourselves the time, money, and hassle of fighting over it? And please see a trademark lawyer with domain name experience (not me) about registering the new name as a trademark. If you have money to burn, the trademark lawyer might even be able to register the old domain name as a trademark and force #3 to surrender it to you.
