Legal Question in Technology Law in California

My "friend" started a web hosting company and I decided to host my website through him. I found out that he downloaded all of the files from my account and stole my work. He isn't using them, but is that considered theft?

Yes, it is theft and how do you know he isn't using them? Digital assets (i.e. computer files) ARE stolen and can be considered theft.
