Legal Question in Technology Law in California

Is it illegal to post pics on the internet?

I have an online album on myspace that has pictures of my ex boyfriend's children (which I raised for 5 years) in it. There is nothing wrong in the pictures. They are just average everyday pictures of the kids (i.e. birthdays, roasting hot dogs on the campfire, Halloween). The mother knew about the pictures and has even left comments on how nice the pics are. Now she is trying to raise the issue in court that I did not have her consent. Can I get in trouble for this being that she knew about it and never asked me to remove them? In fact she has even copied some of the pictures for her own album.

It would help to know why you and the kids' mother are in court in the first place. Did she sue you for posting the pictures? Did the issue come up in a dispute between her and the father? Is there some other explanation?

Your post also doesn't say where the kids are now. If their parents have reconciled and their mother is now raising them again, she may very well have the right to demand you remove the photos.

I suggest re-submitting your question under family law so that lawyers who practice in that area will be able to respond.
