Legal Question in Technology Law in California

Internet Fraud Consumer Protection

I purchased a Business Phone system over the internet, advertised on Ebay for $3501, paid via a wire transfer and never received the system. I was sent an entirely different item. The seller refuses to contact me.

I am from California but the seller is from SC. The advertisement was originally listed on Ebay which is in California.. Where do I file a lawsuit for fraud? I need help please..I have full documentation to support my case.

Re: Internet Fraud Consumer Protection

You will have a difficult time finding an attorney to represent you unless the out of state seller is an established business and a class action lawsuit might make sense.

You can represent yourself in either small claims court or the superior court of limited jurisdiction. Small claims courts may require you to personally serve the defendant in California.

Another resources is eBay itself, which has partnered with a private provider of alternative dispute resolution services, such as mediation. More info at http://pages.ebay.com/services/buyandsell/disputeres.html
