Legal Question in Technology Law in California
Internet Letters
I received a letter: Make $250,000 in wks As seen on Oprah & 20/20
You send $1.00 to each of 6 the people on the list, remove the 1st name and move others up putting yours on #6 Make 200 copies get mailing list labels & send them out. It stats It is 100% legal refer to title 18 section 1302 & 1342 of the postal & lottery law etc. which states a product or service may be exchanged for money received. Every $1 bill you receive containss a note that reads 'please put me on your mailing list.' This simple note makes it legal because you are exchanging a service-adding the persons name to your mailing list for a $1.00 fee. My question is, would it be legal to e-mail the
letter? Thank you.

Re: Internet Letters
Perhaps not, but why would you even consider it? This is a scam. Ponzi scheme, pyramid scheme, etc.
My colleagues are correct, by the way, though the letter mailing may not violate sectons 1302 and 1342, but what about all the other code sections that it MIGHT violate.
Not worth the risk. Don't fall for it.
Re: Internet Letters
As seen on Oprah's and 20/20's ponzi scheme shows, most likely.
Even assuming the underlying scheme was legal (I doubt it - do some poking around on the FTC and USPS websites and I think you'll find some info. on these programs), you are highly likely to violate other laws by sending unsolicited email.
Re: Internet Letters
So you're an aspiring internet scam artist. If I were you, I'd keep my day job.
Re: Internet Letters
Look at it this way. I have carefully reviewed every aspect of your proposed e-mailed letter scheme, and I can absolutely, positively guarantee you and everyone you send your letter to that it does not violate California Penal Code section 187!!!!!!!
The problem is, Penal Code section 187 defines murder.
I haven't even bothered to look at USC Title 18 Sections 1302 and 1342, because the scheme probably doesn't violate them, either.
OK, that clears the scheme on three of about 1,000,000 laws making various things crimes.
Who's to assure you this scheme doesn't run afoul of one, or six, or sixty, of the remaining 999,997 criminal laws????????
I can almost guarantee you it does.
It has all the hallmarks of a "Ponzi scheme."
