Legal Question in Technology Law in California

Invasion of Privacy in the work place

In 2005 I was reprimanded for over usage of Internet, after a grievance was filed on my supervisor, now I am awaiting a skelly hearing after another greivance and another report was ran on my usage. In my paperwork awaiting the hearing is an ''Electronic Communications'' Policy that was implemented in 2002 and that I have never seen. Neither have any of my other co workers. The policy also has a form attached for a signature from the employee to advise them they are to be monitored yet I have never signed one. Can I fight this in my hearing? Also I did research and discovered that 70% of the usage is all work related....

Oh, you are a public employee surfing the 'net on the taxpayers' dime. Well, the law is on your side, especially if the policy is too vague, too strict, or if you didn't have notice of it. Find a good attorney or union rep who reprsents employees at Skelly hearings. The direction the cases are going, at least in the public employee arena, is that some personal use of the Internet is OK and even helps employee productivity. Now hang up and get back to work.
