Legal Question in Technology Law in California

A lap top was stolen from my office. I viewed the surveillance and have a suspect the employee came in with a carry case or bag that appears to be light weight upon her arriving to office and when employee left the office the video shows that the same carry case is fuller in width and appears to be heavy due to the firmness of carry strap and the employee is more guarded. I want to interview this suspect. If she took it I just want it back and I will not press charges. I need to know from a legal stand point what should I say or not say to this person

The company's security people, or human-resources folks should be the ones to confront the employee. Care should be taken not to accuse... this can be a very touchy issue.

If you're the owner or a superior of the person in question, you may have the right to question the suspect, but HR should be involved.

It's improper to accuse without some real proof. Your suppositions about the contents of a bag/case are just that... suppositions. The inferences may be justified, but an accusation of a crime is a serious matter and can get you sued.

Maybe you SHOULD get the police involved. It's their JOB to handle this kind of thing.
