The legality of console game backup devices

The question of legality of Backup devices and emulator has come up recently

our stand on it is:

1) our unit has the ability to make back-ups ( for archival purposes)

2) We do not provide the emulators ( our unit supports them, but then so do millions of home computers)

3) BY not supplying backed up games to the customer, we beleive we are keeping ourselves away from any wrongdoing

and considering the successes the BLEEM! company has had in the courts lately

we , are looking to know if our product needs to be altered for legal reasons.

From the facts as you present them, you would be doing nothing different than a VCR manufacturer vis-a-vis copyrighted videotapes. You would therefore not be liable for contributory copyright infringement of PSX games.
