Legal Question in Technology Law in California

Message Board Copywright

When posting on a message board..

If I post a message that has a link

Example:

http://www.nfl.com/

Do you see a way that copywright laws can be violated? Do you see how other laws can be violated?

If the link violates an internet law, (pornography or similar) Is the poster liable? or is the posting board administrator/site liable?

The reason I'm asking. There are posting boards where links are not allowed.. board administrators fear that they can be responsible for renegade posters. I'd like to know what the law really says. What are the real risks for message board moderators?

Re: Message Board Copywright

Rather than confusing you with all the scenarios and exceptions that relate to your question, I would refer you to some excellent materials on the U.S. Copyright Office website located at:

http://lcweb.loc.gov/copyright/

From the site, scroll down to "Legislation" on the right hand side of the page. Choose the "Digital Millenium Copyright Act" html. (I believe you will need Acrobat Reader to access the file on this link). Once in that link, access "Title II," which outlines some of the governing law for the issues referenced in your question. After reading this information, you should go to back to the home page and scroll back to the top. In the middle of the page at the top, access the file "Copyright Basics." This is an excellent and user friendly document that will educate you on general copyright law concepts. After reading these two documents, if you still have questions, then either re-post a on law guru or contact me directly. With this information digested, I think you will be able to "hone" your issue(s) (and follow-up question) more succinctly, which in turn will permit the attorney to provide a response that is more direct and ultimately, for you, more useful for your particular situation.
