Legal Question in Technology Law in California

Posting photos online

I work for an adult for-profit website. We have some non-sexual photos of Gay Pride Parades and other promotional events open to the public. We want to post some of these images on our [paid] membership website. We have signed releases for the professional models who appear in the photos, but must we obtain signed 'model releases' from any and everyone in the shots - even in the crowd? Would any potential liability depend on a distinction between the photos being tasken at free events as opposed to paid-admission events?

Yes, the potential liability might depend on whether the photos were taken at free events or paid-admission events.

Your company needs legal advice to cover a specific situation. An attorney would have to review the photos to provide competent legal advice. If your company operates an adult site on the Internet, it should already be getting legal advice, as there are many traps for the unwary in that industry. If you are having trouble finding an attorney in your area who will help you, contact me at http://www.timothywalton.com and I will try to help you find somebody.
