Stolen nude photo

I recently discoved that someone had posted a nude photo of me in a personal profile on yahoo's website. They then linked photos from my real profile to insure that everyone would associate my name with the picture. I was the one who took the photo, and it was taken in the privacy of my home so I own all rights to it. I have never posted it online, and the only place it exists is on my hard drive, and on the computer of an ex. Are there any steps I can take to have it removed and file a legal complaint?

You should probably start by telling Yahoo what happened and demanding that they remove the photo and shut down the offending profile. You should also demand that they preserve all records of that profile for use as evidence, since you will likely be bringing a lawsuit against whoever posted the pics.

You really aren't likely to have a case against Yahoo, since it almost certainly didn't know the pic wasn't legit and since it has no control over what users post. If only your ex could have obtained the photo and if he/she had no authority from you to do so, then he/she seems like the person you would need to sue.

[Of course, a suit might not be necessary if you can think of a settlement amount which will satisfy you and which will be paid by him/her.]

With all due respect to other attorneys who are answering questions here, there is an easy way to get it removed from the Yahoo! site. Since you own the copyright, simply send a DMCA letter. You can free info on how to do this for yourself by going to http://www.chillingeffects.org.
