Legal Question in Technology Law in California
Unauthorized Email Access
I have been legally legally separated from my wife for over 6 months and the divorce is in process. I recently realized that someone has logged into my personal email account and has forwarded emails from my account to her email address. Does this violate any privacy laws and there any legal statutes?

Re: Unauthorized Email Access
If you wanted to pursue this, and you could afford the legal and expert witness costs, you could theoretically file a lawsuit against John Doe (the hacker) and subpoena the logs from the ISP hoping to get the internet IP address from which they accessed your email address. Then you could, again theoretically, subpoena the ISP at that IP address to get the person's name (unless they were clever enough to route the access through Romania or to otherwise disguise their IP address somehow). Only then would you find out if that person has money or assets worth suing over.
