viewing and forwarding e-mails

a friend of mine was able to get into his girlfriends e-mail account, view sent e-mails, and forward them to other people in her address book.

Is this a criminal or civil matter, and will it likely be persecuted if he only did it once?

While it could be either a civil or criminal matter, the police are less likely in my opinion to make it a criminal matter than the girlfriend would be to make it a civil matter.
