Legal Question in Technology Law in California

web disclaimers

I want to start a Cystic Fibrosis website for prayer and networking (resource/ideas sharing.) I am concerned about liability. Since its difficult to insure that visitors dont post medical advice or product / information links that are accurate and safe. Is it true that a disclaimer alone can ensure that I am not sued or do I need some type of contract/ insurance?

Re: web disclaimers

Anyone with $300 can sue. A properly worded disclaimer can prevent that person from winning, however. Insurance is always a good idea, and may provide you with an attorney to draft your disclaimer. If you do not have insurance that will pay for an attorney, you should retain an attorney on your own. The disclaimer you need is specific to your site and it is not a good idea to think that a disclaimer that appears on another site will provide the protection you seek.

My cousin had Cystic Fibrosis. If you want to discuss your ideas for your web site, I would be happy to talk with you on the telephone at no charge. I can be reached at (650) 842-8481.
