Legal Question in Constitutional Law in California
as applied challenges
When does ''as applied'' begin? For
instance, if you are driving a car and
pulled over for going over the truck
speed limit, is it when you're pulled
over, when you have to fight the
ticket, or only if the magistrate finds
you guilty because you had no proof
your Ford Mustang wasn't a truck?

Re: as applied challenges
It's up to the prosecution to prove, beyond a reasonable doubt, that a Mustang is a truck. Get ahold of "Fight Your Ticket" from the law library at the courthouse or nolo.com .
