Buyer a supplier ask Seller a manufacturer, to submit a proposal for manufacturing a telescope. A few days later, Seller sent Buyer a letter, Offering to manufacture a telescope within a commerically reasonable time period at a price to be agreed upo at a later date when all of Seller's costs were known. Upon receipt of the letter, buyer called seller. During this telephone conversation, Buyer stated, I accept so long as the price does not exceed $400 and you can deliver the telescope by May 1 seller assented to Buyers response.
Buyer sent seller a written, signed confirmation the next day, listing a May 1 delivery date and stating that the price shall not exceed $400. After receiving the confirmation, Seller began to manufacture the telescope.
On May 1, Buyer learned that Seller completed the manfacture of the telescope, but sold the telescope to another supplier for $500

Law Student gets take-home final exam but did not study enough during the semester and cannot answer the questions on his own.
