Legal Question in Constitutional Law in California

personal jurisdiction

I am a sport agent. I had a contract with a player from Venezuela to represent him. I also loaned him some money. The contract was entered in CA. The contract states that we agree to the laws of CA but it does not state any agreement on CA jurisdiciton.

The player breached the agency contract we had and singed a contract with a major ball club directly by himself. Secondly, the player made two payments to repay the loan but since then no matter how many how many letters we write to him, it is being completely ignored. He has not paid anything since.

Durning non-season he spends his time at Venezuela. During the season he comes to FLA but he does not come to CA.

My questions are: Where is the best jurisdiction to sue him, CA or FLA? Is it possible to sue him in CA when he is physically in FLA? Is it possilbe to sue him in FLA even the contract was entered in CA and we agreed to CA laws? Thanks,

Re: personal jurisdiction

the general rule is that jurisdiction in a contract case is where the contract is to be performed. you can also get jurisdiction based on a persons residence. i would file in CA first and if that doesnt work try FL next.
