How can i retrieve property seized from me in a search warrant?

You can make a motion to suppress evidence seized pursuant to a warrant. However, if the warrant was proper the evidence will not be suppressed. Under Penal Code section 1536-1538, you can seek the return of property seized under warrant, if the property is not evidence in a criminal matter. Evidence can be returned once the criminal matter is concluded under the same criminal code provisions as long as the property is not contraband.
