Legal Question in Constitutional Law in California

Are teachers in California Public Schools allowed to leave their students unsupervised? My daughter is a 9th grade student and during lunch a teacher allow the students to stay in her classroom and eat. The teacher grabbed her lunch and then went to the teacher lounge to eat. She left 8 students totally unsupervised for 45 minutes. Some of the other students drank alcohol during this time, my daughter was not one of them and when she took the breathalizer test (4 times they made her take it) she was a 0.00. She was still suspended because she was in the classroom. The school was not forth coming about the fact that their was no teacher in the room. I am appealing the suspension on Monday, but I am curious to the laws. I remember being in High School and being told we could not stay in the classroom when teachers weren't present. If if is illegal where do I find the law? Apparently this teacher lets children stay in her classroom unattended at lunch on a daily basis. Thank you for your time I greatly appreciate it.
