Legal Question in Construction Law in California
3 years ago I received a letter from a law firm asking if we wanted to retain them for a class action law suite that they were pursuing against the builders of the home we purchased which I signed. We recently received a phone call to inspect our home from that law firm after 3 years. Our house is past the warranty period now.
My question is this. Can we opted out of the class action law suite now? and if so how? The reasoning is after doing research people are saying it not worth it because you will not get any where near the money you need to fix the problems they find plus you will have to disclose it later when you sell the property. Also having a class action law suite pending will now allow you to sell the house until it's settled. thanks

Sorry, I don't know the answer to the class-action suit question, but I thought that I should point out that you'll have a duty to disclose any problems or defects that you know or suspect to a prospective buyer, whether or not there is or was an active lawsuit.
