Legal Question in Construction Law in California
bad contractor
the contractor that we chose to build our new home was 1 year over the 1year time limit he did a terrible job. did not install stove dishwasher. very poor workmanship throughout the house. kept $6,500 we paid him to install septic tank wont give it back,his wife/secretary sent me a satisfactory of completion form to sign and a note saying they would return money when we signed form. the house has not had final inspection. contractor abandoned the jobsite.i have to apply for another building permit to get final. ive stayed in motels since march 2006. the contractor has cost us thousands of dollars.his wife kept putting us off making excuses.we just found out the contractor died 10-14-06. his wife has been lying. she has already cancelled his contractors license the day he died.we have turned him over to state contractors board. they tell us now since he is dead they can not do anything about this. what can we do?

Re: bad contractor
You may be able to make a claim against the estate of the deceased contractor. The wife may be a co-owner of the business and be co-liable for the breach of contract and negligence. A lawsuit for breach of contract against the wife and the estate could be brought.
