Legal Question in Construction Law in California

Billing when shipment item is not and will not be available

Purchased online a $1,600 TV. Website stated free massage chair with purchase. Received email stating shipment date is not available so call Cust Svc. They stated to cancel and reorder in 3 days. Went into retail store and found out item is no longer in warehouse or even available.

We found item in 1 retail store and purchased it. We were charged for free chair without permission as we did not 'buy' it, it was a free item with purchase.

They also charged for TV before shipping, also knowing item is no longer available! Thought store could not charge before shipping item.

I am not sure what you are asking. File a small claims suit to recover your money and/or cancel the purchase if you can.
