Legal Question in Construction Law in California

After completing some work for another contractor and not being paid. How long can wait before it is to long to not be able to sue the contractor? Since its been almost a year since we tried to get paid but there has been no response from the contractor.

The statute of limitations for a suit based on a written contract is four years from the date it is breached; if you had only an oral agreement, the limit is two years. You are usually more likely to collect the sooner you sue, so you probably shouldn't wait unnecessarily just to see if you get a voluntary payment -- after one year, voluntary payment is quite unlikely.
