Legal Question in Construction Law in California
A construction company pays $25 a day per diem and they pay for lodging. Are they in compliance in California or should they be paying more per diem? They are out of state. I have seen what GSA.gov says for comparision but I can not find anything on contractors working on non public or non goverment contracts.

California law requires employers to pay actual cost for meals, lodging and incidental expenses, OR the IRS per diem rate for the locality to which the employee is sent. If they pay actual out of pocket lodging, they must pay the IRS rate for M&IE;.
