Legal Question in Construction Law in California
construction law: I had a construction job, I completed the rough framing 12-20 16, which included a sheathing and shear inspection on that day, after getting home I read an email by the owner asking to take over job due to budget, not a big deal, we have always let this be open for the owner to do. Yes there is a contract, project manager primarily. After 3 days, 12-23-16 she complains about the OSB getting wet and that she is placing tarps over the house. She also commented in the email that she would take care of any damage, if any, herself. Then comes 12-30-16 she claims there is 4000.00 in damages and takes it out of my check. I tell her, it's on her because she took over the house on 12-20-16 and also I was just supplying labor and a few other services and that she is 100% responsible. Now I want to lien her home and then go to small claims for the 4000.00. Question is , is anyone seeing an issue or concern on my part with this?

You can't enforce a lien in small claims court. Other than that, go for it.
