Legal Question in Construction Law in California

Our church is planning some painting

and minor remodeling. Does

California law require us to use only

licensed contractors if over $500 or

are we within the law if we hire

people we know are not licensed?

Part of our work is painting of inside

rooms, worth about $2000-3000.

We think we are safer and better off

with a licensed contractor, but are we

required to use someone licensed?

Perhaps the biggest risk involved in using unlicensed contractors is that they are ipso facto your employees. If you do not carry workers compensation, you'll be liable for their injuries, if any should occur.

Beyond that, licensed contractors are bonded, so you've got a minimal means of recourse if the contractor violates the California license laws that control the conduct of contractors.

Whomever you decide to hire, it's a good idea of have one of your lawyers (there has to be one in your congregation if not on staff) draft or review a basic written contract, which both sets everyone's expectations on the same page and makes it easier to resolve disputes if any arise.
