Legal Question in Construction Law in California

Contractor's liabilily

I work for a granite countertop company. In replacing our client's top, we moved their new stainless fridge forward from the usual spot to get to the counter.Their teen daugher opened the fridge door during the constuction period(8 hrs)to get some food, and because the fridge was not in it usual place the door knocked against the oven's edge resulting in a dent in the fridge door. The client say we should have covered the oven with a tarp. We content that they were aware that the fridge is not in its usual spot and that the family should have taken extra precaution when using the kitchen during the construction period. The family says it was a child who opened the door, our contractor say that it's was someone who is in her teens. Who's liable?

Re: Contractor's liabilily

In this case, liability would be assigned by a judge or jury. My best guess is that they'd assign a portion of blame to both the contractor and the family. How much would be assigned to each party is anybody's guess.
