Legal Question in Construction Law in California

Engineer drawings info

I provided the engineer with a basic

landscape design layout of a wall and

planting beds. He returned a full

engineered drawing to me and I

completed the planting plan to show

exactly what plant should go where. He

designed the wall so that it only allowed

8'' of space for the plants and trees.

The homeownere wants me to

remimburse her for my design time.Am

I to be held responsible for

understanding the footing drawings of

the engineered wall?

Under the facts as you presented them, I don't see how you are responsible. However, the answer to your question depends factors that you have not mentioned.

It sounds like you presented a conceptual design to the owner's engineer and it was up to the engineer to provide the necessary design specifications. Unless the engineer's scope of work was considered part of your services, I don't see you being responsible.

Also absent from your question is a discussion on whether or not other feasible alternatives exist to achieve the owner's goals. The engineeer might even be willing to put in the time to any necesary redesign, particularly if the engineer really did make a mistake.
