i am a general contractor . if i use a carpenter with his license on my job and 1099 him am i obligated to have workmans comp.

As a general contractor, you should carry worker's comp as a general matter. There is a risk that the carpenter will change his position about being an independent contractor right after he gets hurt on the job.
