Legal Question in Construction Law in California
hi there - i hired a cabinet maker to produce a set of custom cabinets for a kitchen in california. we signed a contract, and i gave him a deposit. he told he would be able to deliver in no more than 8 weeks from when he took measurements. he took the measurements, and i received an email stating the dates the cabinets would be made and the date they would be installed. the 8 weeks passed, i called and was told the cabinets have not been made but perhaps they will be reading in a month. i sent a demand letter stating breach of contract and received a refund of the deposit. can i sue in small claims court for the cost of having my construction manager find a replacement cabinet maker? for having to rent another abode for a month while the second set of cabinets are made and installed? thank you.

Yes, you an sue for whatever the new cabinets cost you in excess of what you would have had to pay him had he performed as promised, plus any additional costs incurred due to the delay and disruption of the project.
