Legal Question in Construction Law in California
I hired an unlicensed painter to paint and stain my entire interior house. Days after he finished & was paid, paint started bubbling and peeling off the wall. We gave him the opportunity to come back and fix it and now he will not return our phone calls. We have gotten quote from another painter on how much it will be to fix his mistakes. We want to take him to small claims court for A. not doing work that held up more than weeks and B. not finishing all the work. What would our next step be and do we have a case? We have photo documentation and a written quote from another painter that the job was performed incorrectly.

You answered your question yourself. Go down and file a small claims action. As an unlicensed contractor, he is actually required to give you all your money back on demand, even if the work was done correctly.
