Legal Question in Construction Law in California

I had my home extensively remodeled by adding a 3 rd floor in san Francisco, ca. Now 5 years later, and after several "fix-it" repairs, the tile floor is still loose, hardwood floor has gaps/cracks/buckled, and leaks into master bedroom ceiling and downstairs unit.

The contractor said there was only a 1 year waranty, and won't fix anymore.

What to do?

Point out to the contractor that defective construction is subject to a four-year statute of limitations that cannot be reduced by contract, and that four years runs from the date the defects were or could have been discovered. There is also a ten-year statute of repose that allows you up to ten years from completion to discover defects. If he still won't fix his work, file a complaint with the Contractor's State License Board and a claim with his license bond company. If the amount of the bond is not enough to cover the repairs, I would be happy to give you a free half-hour consultation regarding other options.
